Arbitration Fee Schedule  6 1 2004

For full day arbitration, the arbitration fee is $900.00 per party for the hearing day, for a half-day session, the fee is $500.00 per party for the hearing time. The arbitration fee is due upon arrival at the hearing facility or by arrangement prior to the beginning of the first session. As an option to benefit your clients the mediation fee may be paid by Visa or Master Card prior to the start of the mediation session.

 

For purposes of the arbitration fee, all parties represented by the same law firm or attorney are considered to be a single party.  A half-day session is defined as four hours or less; if a half-day hearing extends past four hours, the charge is $112.50 per hour per party, pro-rated for periods of less than one hour in 15 minute segments.  The total arbitration fee per party for a half-day session will never be more than the arbitration fee per party for a full-day session. If a third session is required in one day the fee for the third four hour session will be based upon $225.00 per hour divided into 15 segments.This fee will be payable at the beginning of the session. An administration fee of $125.00per side will be charged to set up the arbitration and to conduct the Initial Pre hearing conference, payable at the time of confirming the hearing date/dates, but no later than 10 days prior to the pre hearing conference.

 

If any arbitration hearing is canceled within seven (7) days of the scheduled hearing this fee will be increased to 35% of the hearing day that was scheduled. The hearing may however be rescheduled due to conflicts in an attorney’s docket schedules if an attorney is present at the arbitration. 

 

The arbitration fee includes administrative expenses incurred in arranging the arbitration, use of the hearing facilities, the time for the actual arbitration session, any extension into the evening hours, and the arbitrator’s incidental expenses such as photocopying, facsimile transmissions, postage, long distance telephone, and supplies.  Out-of-town arbitration hearing facilities and travel expenses are billed at cost.  The arbitration fee of $225.00 per hour $112.50 per side will be charged for the preparation of the Arbitration Award in writing.   

 

The normal starting time for the arbitration hearing is 9:30 A.M., an hour lunch break, and, the hearing continues until 6:pm or may stop earlier upon agreement of the parties.

 

If more hearing time is needed, the parties may by agreement schedule additional hearing sessions at the end of the first scheduled sessions and the fee will be as stated above.  If the parties know in advance of the first session that more than one day will be required to complete the arbitration successfully and accordingly schedule a second session, the full fee for all scheduled sessions is due and earned at the start of the each arbitration session. The final bill for the preparation of the Arbitration Award will be payable upon notice by the arbitrator 7 days from the date of invoice. The Arbitration Award is binding/non binding on the parties as per their written agreement.
